Terms of Service

1. Acceptance

By accessing expato.eu and using its services, you accept these Terms of Service, together with the Legal Notice, Privacy Policy, and Cookie Policy. If you disagree, do not use the Site.

2. The Service

Expato ("the Site") is a platform operated by Oleh Veheria (trade name: "Futurist Systems"), self-employed with Spanish tax ID NIF Z2284211V, registered at Calle Ríos Besos, 16, P01 E, 30700 Torre-Pacheco (Murcia), Spain. Contact: oleh@veheria.tech.

The Site offers relocation guides, a service directory, a community forum, an AI assistant, and paid subscriptions for featured directory listings.

3. User Account

• Registration uses a magic link sent to your email. You are responsible for keeping your account secure.
• You must be at least 16. Minors require a legal guardian's authorization.
• One person or business = one account. Duplicate accounts, bots, and impersonation are prohibited.
• We may suspend or close accounts that violate these Terms, without refund where the breach is attributable to the User.

4. User Content

By posting content (forum, listings, comments), you:

• Retain ownership of your content
• Grant Expato a non-exclusive, worldwide, royalty-free, sublicensable license to display, translate, distribute, and promote your content on the Site and associated channels (email, Expato's social media)
• Represent that you have the necessary rights and that the content does not infringe third-party rights

Illegal, fraudulent, defamatory, obscene, hateful, violent, spam, or impersonating content is prohibited. We may remove content that violates these rules, without prior notice.

5. Business Directory

Directory listings must correspond to real, legal services provided in Spain or to expats in Spain. The business owner is responsible for the accuracy of published information.

Expato does not professionally verify all listed businesses. A "verified" badge, when shown, only confirms that we checked certain basic facts (business exists, contact works), not professional service quality.

6. Subscriptions and Payments

• Basic, Pro, and Premium plans are processed through Stripe.
• Displayed prices include VAT when applicable under Spanish tax law.
• Subscriptions renew automatically until you cancel from your dashboard.
• Right of withdrawal: under Spanish Royal Legislative Decree 1/2007, you have 14 calendar days from subscription to withdraw without justification, except where the service has already been performed with your explicit consent (featured listing already published).
• Pro-rated refunds only in cases of technical error attributable to the Site. Subscriptions voluntarily cancelled mid-period are not refunded.
• Invoices are issued in the account holder's name and sent by email.

7. AI Assistant

The AI assistant provides general information based on the guides and public sources. It does not replace professional advice (legal, tax, medical). Responses may contain errors; verify critical information with qualified professionals.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Site is provided "as is," without warranties of availability or accuracy
• We are not liable for indirect damages, lost profits, or data loss
• We are not responsible for disputes between users or for services provided by directory businesses
• Our maximum aggregate liability is limited to the amount paid by the User in the preceding 12 months

Nothing in these Terms excludes liability for willful misconduct, gross negligence, personal injury, or consumer rights that cannot be waived by law.

9. Intellectual Property

Code, design, the "Expato" brand, and the Site's original content are owned by the operator. Personal reading and use are permitted. Commercial reproduction, mass scraping, and derivative works without explicit consent are prohibited.

10. Termination

You may close your account at any time from your dashboard. We may suspend or close accounts for breach of these Terms, service abuse, or legal requirement.

After termination:

• Invoices and tax records are kept for 6 years by legal obligation
• Public generated content remains unless you explicitly request deletion
• Rights previously granted to other Users (e.g., visibility of their replies to your posts) are not affected

11. Changes

We may modify these Terms. Significant changes will be notified by email at least 30 days in advance. Continued use of the Site after notification implies acceptance.

12. Governing Law and Jurisdiction

Spanish law. Jurisdiction of the Courts of Murcia, except for consumer relations (consumer's jurisdiction). European ODR platform: https://ec.europa.eu/consumers/odr.
